The “Code of Jewish Law”, the ...
Shulchan Aruch” & “Halacha

With Dr. Rabbi Reuven Ben Avraham-Goossens, PhD.

Introduction:

On this site we will be showing the most blessed four letter Name of the Almighty, known as the “Tetragrammaton” or better as the - “Memorial Name” of our beloved Creator יְהוָה – YaHVaH,  ברוך שמו לעולם- “Baruch Shmo Le’olam” - “Blessed be His Name forever.” Sadly in great error we been saying instead of the blessed “Memorial Name” - Adonai (LORD) or HaShem (The NAME). The blessed Name of Elohim had been used for several thousand years, until priests and rabbis simply removed it without permission from Elohim, blessed be He. However, as we know from the Tanakh, Elohim, blessed be He, was angry with the priests (and rabbis) so much so that He cursed them, and He clearly stated:

And now, O priests, this charge is for you: obey and unless you lay it to heart, and do honour to My Name said Elohim of Hosts, I will send a curse and turn your blessings into curses. Indeed, I have turned them into curses, because you do not lay it to heart. I will put your seed under a ban, and I will strew dung upon your faces, the dung of your festal sacrifices, and you shall be carried out to its heap.” Ma’a’chi - Malachi 2;1-3. (JPS).

It is sad that we had to lose the precious Name, because of men who had lost their way, much like that evil occultist Kabalistic cult, that is once again taking over once in so many Synagogues! Pray that our beautiful Faith will return to where it should be! However ensure that at all times that we treat the most Sacred Name with great Sanctity, and when we even use or see the blessed and Sanctified Name, we should say - ברוך שמו לעולם - “Baruch Shmo Le’olam”  Blessed be His Name forever.” In addition, unlike the Rabbis, I will not use the pagan word ‘God’, believe me it origin is totally pagan and it is mentioned in our beloved Tanakh by Yahushua – Joshua who spearks of Baal-Gad, than pagan deity is also mentioned by Yeshayahu - Isaiah.

Throughout this site I will use three versions of the TaNaKh - “Jewish Publication Society” (JPS), “Sefaria.org” (SEF) & “Mechon-Mamre.org” (MEC) - Torah = History & Law / Nevi’im = the Prophets & *Ketuvim = the Writtings).

*Ketuvim include: Poetical books - Psalms, Proverbs, Job, the Megillot, or Scrolls - Song of Solomon, Ruth, Lamentations of Jeremiah, Ecclesiastes, and Esther, prophecy of Daniel, and history of Ezra, Nehemiah, and Chronicles I & II.

*However, I have made some alterations in regard to Names, just as they were shown in our ancient scroll’s, which I have read in Yerushalayim - Jerusalem! Thus I have been returning to the actual names as they were in our sacred ancient Scroll’s! For the סוֹפְרִים - Sopherim (scribes’), Priests and Rabbis sadly went against Elohim’s Commandments and removed His precious Sanctified Name which was to be “FOREVER”!

And Elohim said moreover unto Moshe: Thus shalt thou say unto the children of Yisroel: יְהוָה, the Elohim of your fathers, the Elohim of Avraham (Abraham), the Elohim of Yitzchak (Isaac), and the Elohim of Ya’akov (Jacob), hath sent me unto you; this is MY NAME FOREVER, and this is My MEMORIAL UNTO ALL GENERATIONS.” Shemot – Exodus 3:15. (JPS).

The “Code of Jewish Law, the ...
Shulchan Aruch & “Halacha

Introduction:

The term “Halachah” means “the way” or “path” and it is often used interchangeably with “Jewish law,” but it is merely an analogue for the “Oral Law”. “Halachah” which is a man made comprehensive legal framework that guides every aspect of Jewish life, including ethical, ritual, and civil matters. Even though it will quote just small parts of verses from the “Torah,” but in truth the vast majority comes from that “Oral Torah”! WE should ask when did it come about?

The “Oral Torah” came into existence first as scrolls, then in a written form, and eventually in book form. This process took place between it is claimed in the 2nd and 6th centuries.

Thus “Halachah” is mostly based on whatever the non scriptural “Talmud” says. “Halachah” also exists in the form of a legal code such as by Rambam’sMishneh Torah” and of course the “Shulchan Aruch” or the “Code of Jewish Law”. Let us at just one of these rabbis laws!

In the “Code of Jewish law” there is nothing short of a very weird law. It is located in Volume One, in Chapter 5, and the very last item No 17 has the following.

“If a man’s heart could view his genital organ that is that no garment or girdle separates the upper part of his body from the lower, he is not allowed to utter anything holy, even though his nakedness is covered.

It continues with:

“He must either put on trousers that are tight on his body, and must gird himself with a rope (or a tight belt) in order to make a separation between his heart and his organ. There is no reason for a woman to do that.”

In short it does continue to tell us that a man must have “something tight around his waist, a rope or a tight belt” so “that his heart cannot see”, well you know what! In other words if he is correctly dressed, but if has not something very tight around his waist he cannot pray or utter anything sacred. Therefore if you are ill, and in hospital wearing your pyjamas you are forbidden to pray! Realy?

“He must either put on trousers that are tight on his body, and must gird himself with a rope (or a tight belt) in order to make a separation between his heart and his organ. There is no reason for a woman to do that.”

The “Oral Torah” or “Torah Shebe’al Peh” - תורה שבעל פה, or the “Torah of the mouth” (the mouth of men, being rabbis) refers to the “Oral Law” and the “Talmud” and its commentaries, which refers specifically to the Oral traditions and interpretations that were passed down through generations. Initially, these teachings were transmitted verbally and later recorded in texts such as the “Mishnah” and the “Talmud”. These writings serve as the foundation for “Halachah”, elaborating on the laws found in what it will always be, a 100% man created “Written Torah”.

To break all this down further:

Component:                    Description:

1... Written Torah:          The tradition of explanations, interpretations, and rulings transmitted orally, that was later committed to writing, e.g., “Mishnah” and the “Talmud”.

2... Oral Torah:               The tradition of Rabbis explanations off their own interpretations, and rulings transmitted orally, later committed to writing in the “Mishnah” and the “Talmud”.

3... Halachah:                 A full body of Jewish law which includes some of the “Written” and much of the Oral Torah, regarding (mostly men made laws) to guide our living.

Summary:

if you refer to the “Code of Jewish law,” you are essentially talking about “Halacha”. Whilst the “Oral Torah” plays a much larger role as the Rabbinic interpretations of traditions is mostly behind “Halakha”, but it is not synonymous with the entire legal code, for it is rather, one crucial element to shape a broader “Halachic” system.

This complex relationship between the actual “Torah”, and the man made “Oral Torah”, and “Halacha” not only illuminates the depth of Jewish traditions, but also highlights how dynamic and adaptable a legal system can be when it melds foundational texts with interpretative human traditions.

Maimonides known as Rambam:

There is no doubt that Maimonides was a monumental figure in shaping parts of the new Jewish law much later, using his work in codification and rational analysis. Living during the medieval period (1135 & 1204 CE), he sought to streamline and simplify the vast tapestry of Oral traditions. Yet Talmudic debates simply accumulated over centuries. His goal was to create a systematic guide for Jews to follow, regardless of their background.

The Mishneh Torah:

The “Mishneh Torah” is a code of Rabbinic religious law (halacha) authored by ‘Maimonides’ being ‘Rabbi Moshe ben Maimon’.

It is a huge code that organizes Jewish law into a work of today’s “Code of Jewish law” which is a work containing four Volumes covering all we are bound to do and keep for all of our lives.

The “Code of Jewish law” or the “Shulchan Aruch” covers ritual practices, civil law, ethical conduct, and much more. Unlike previous texts, that often left readers navigating through the interconnected “Talmud” and the “Mishneh Torah” which presents legal rulings in a sequence. What is assumed to be ‘clarity’ has, as rabbis claim, made Jewish law more accessible to laypeople, but they also allowed a precedent for later new added codifications in the “Shulchan Aruch”, thus parts of it hails from dates long after its first printing!

Thus, we could ask, “Which of the Law should we uphold”:

I have been asked the question, “Do we have to uphold all 613 Laws”. I pray that this study will make Elohim’s Law so much clearer.

In answer to the question above the reply is very simple ‘NO’. Why? That is because many of the Mitzvot simply do not apply to you and me at this time!

Here are just a few examples:

Let’s be honest, here are Mitzvot that are directly related to farming, and if you are not a farmer, well you are not required to fulfil these Mitzvot’s because it is only relevant to the farmer.

However, if you have planted a new fruit tree in your garden, indeed, you must offer the first fruits, and not eat from the tree for three years, as prescribed in the required Mitzvot given in the “Torah”, which is as follows;

“And when ye shall come into the land, and shall have planted all manner of trees for food, then ye shall count the fruit thereof as forbidden; three years shall it be as forbidden unto you; it shall not be eaten”. Vayikra - Leviticus 19:23. (JPG).

On Page Two of this Study, you can actually search that page with, lets say the word ‘fruit’, and you will find details, even though there is no Temple, but to this day, we should still return the “first fruits” to the soil. And when really you think about it, you will realise that the fallen fruit in those three years will heave become much like a fertiliser for your tree, or trees!

If you are not a ‘Kohen’, (being a member of the Priestly family of the Tribe of Levi). For none of their Mitzvoth do not apply to you. In fact, even those who are Kohen’s, they can longer fulfil these Mitzvoth, as most can only be fulfilled when there is a Temple.

Here are some Mitzvot:

1... Any Mitzvot related to women obviously cannot apply to men, and the reverse also applies!

2... There are Mitzvot related to war, obviously these only apply ‘to the military’.

3... Any Mitzvot that pertain to a Judge in Jewish Court cannot apply to us, as the law is only for a ‘Judge’.

Thus in reply, to the question asked, further above; “Do we have to uphold all 613 Laws”.

The truth is certainly not all the 613 Mitzvot applies to us all.

However, I do have a page (see the Link at the bottom) that has a complete listing as found in our beloved “Torah”!

Please keep the Torah, all those Mitzvot which does APPLY to you at this time, even there not being Temple, etc!

Obviously, most readers will know that the author does not accept, nor upholds, any of the later added rabbinic, or better said ‘man made laws’. The “Kitzur Shulhan Aruh” or the “Code of Jewish Law” there are some unbelievable man-made laws given, including the one extremely weird, or even a sick one, and I have already quoted it above, in (Volume 1, Chapter 5, item No 17).

Therefore if you are ill, and in hospital wearing your pyjamas you are forbidden to pray, why?

The truth is that certain rabbi’s  of the past have made up these weird laws and have added thousands of additional non Torah “laws” being mostly man-made laws and apparently according to these so called non-scientists (that’s a joke) and men your heart obviously has eyes and it can actually see your genitals”. By the way, this idiotic law does not apply to our beloved ladies, but believe me these rabbis have hundreds of other strange laws that are just as far removed from Elohim’s Totah!

In conclusion:

Elohim, blessed be He, makes it very clear that He abhors man changing His Torah, His Word! For His beloved Torah makes it absolutely clear that no one is permitted to keep any other Mitzvot than those given in the Torah that Elohim gave to Moshe Rabbeinu.

The following are just several examples to be found in the Torah / Tanakh regarding altering the Word of our Elohim, blessed be He!

“Ye shall not add unto the word which I command you, neither shall ye diminish from it, that ye may keep the commandments of יְהוָה your Elohim which I command you. Davarim - Deuteronomy 4:2 (JPS).

“Ye shall observe to do therefore as  your Elohim hath commanded you; ye shall not turn aside to the right hand or to the left. Davarim - Deuteronomy 5:28 (JPS).

“Beware lest thou forget יְהוָה thy Elohim, in not keeping His commandments, and His ordinances, and His statutes, which I command thee this day” Davarim - Deuteronomy 8:11 (JPS).

“All this word which I command you, that shall ye observe to do; thou shalt not add thereto, nor diminish from it” Davarim - Deuteronomy 13:1 (JPS).

“Every word of Elohim is pure; He is a shield unto them that take refuge in Him. Add thou not unto His words, lest He reprove thee, and thou be found a liar” Mishle Shlomo - Proverbs of Solomon 30 5-6 (JPS).

Always keep Elohim, blessed be He, in your prayer’s. Be it a prayer in Ivtit (Hebrew) or English.
